DevIT Software LLC (hereinafter - "we", "us", "DevIT Software") is the Ukrainian company that providers applications to Customers through a https://www.shopify.com Software as a Service (SaaS) model through the website located at https://apps.shopify.com/partners/devit-software, together (the “Platform”). This document applies to all applications developed by DevIT Software.
DevIT Software will use the Customer Data to provide store management, sourcing and selling products, merchandising, up-sell & cross-sell, and customer services at the Customer's request. As the Customer Data is processed automatically, it can be deleted at Customer's request, but not returned to the Customer (DevIT Software does not offer a data storage service).
As used herein, “Confidential Information” means all confidential information of a party (“Disclosing Party”) disclosed to the other party (“Receiving Party”), that is designated in writing as confidential as well as the product generated data, the licensed materials, the functionality of the Platform, and the terms and conditions of this Policy, including but not limited to the pricing and purchase terms of the product or any part thereof.
We may use different confidential information. Since we provide multiple applications, the information we request depends on the application.
When installing any Shopify application, the platform asks for certain information. Accordingly, when installing applications, you allow access to the information that Shopify requires.
According to the Shopify Policy, there are four types of information that an app can access. Citation:
customer personal information, which includes contact information such as name, email address, phone number, and address. Apps that deal with orders, fulfillment, or shipping also require access to location information (such as IP address and geolocation), and user agent information (such as browser and operating system).
Shopify store owner personal information, which includes all contact information for the store owner, including name, email address, phone number, and addresses of all locations.
staff personal information, which includes all contact information for staff, including name, email address, and phone number.
content provider personal information, which includes information about blog authors or commenters (including email address and IP address), and user agent information (such as browser and operating system).
You can find the full article about app permission and personal information on the Shopify Help Center.
The Receiving Party will:
protect the confidentiality of the Confidential Information of the Disclosing Party using the same degree of care that it uses to protect the confidentiality of its own confidential information of like kind but in no event less than reasonable care,
not use any Confidential Information of the Disclosing Party for any purpose outside the scope of these Terms,
not disclose Confidential Information of the Disclosing Party to any third party (except those third-party service providers used by us to provide some or all elements of the Subscription Service or Consulting Services), and
limit access to Confidential Information of the Disclosing Party to those of its and its affiliates' employees, contractors, and agents who need such access for purposes consistent with these Terms and who have signed confidentiality agreements with the Receiving Party containing protections no less stringent than those herein.
The Receiving Party may disclose Confidential Information of the Disclosing Party if required to do so under any federal, state, or local law, statute, rule or regulation, subpoena or legal process; provided, however, that
(i) the Receiving Party will provide the Disclosing Party with prompt notice of any request that it disclose Confidential Information, sufficient to allow the Disclosing Party to object to the request and/or seek an appropriate protective order or, if such notice is prohibited by law, the Receiving Party will disclose the minimum amount of Confidential Information required to be disclosed under the applicable legal mandate; and
(ii) in no event will the Receiving Party disclose Confidential Information to a party other than a government agency except under a valid order from a court having jurisdiction requiring the specific disclosure.
However, we also encourage you to periodically check back and review this Policy.
